  • In writing: includes email.

2. Applicability

  • These Terms and Conditions apply to all offers, quotations, orders, agreements and deliveries of Future Bike, unless agreed otherwise in writing.
  • Before the agreement is concluded, the text of these Terms and Conditions is made available on the Website. After an order, they are sent to the customer by email or another durable medium.
  • General terms of the customer, including purchase conditions, are expressly rejected and do not apply, even if they are referred to in an order or in communication.
  • Deviations from these Terms and Conditions are only valid if Future Bike has confirmed them in writing. They apply only to that agreement.
  • The Return Policy forms part of these Terms and Conditions. If the Return Policy and these Terms and Conditions conflict on returns or withdrawal, the Return Policy prevails.
  • Mandatory consumer protection law prevails over these Terms and Conditions and the Return Policy. Nothing in them limits the statutory rights of consumers.
  • If any provision of these Terms and Conditions is void or cannot be enforced, the other provisions remain in force. The void provision is replaced by a valid provision that comes as close as possible to its purpose.
  • The version of these Terms and Conditions in force at the time of the order applies to that order.

3. Offers, Product Information and Prices

  • All offers, advertisements and price lists on the Website are without obligation, unless stated otherwise. Future Bike may change or withdraw an offer at any time before an order is accepted.
  • Offers are valid while stocks last.
  • We describe our products as accurately as possible. Images, colors, weights, dimensions and specifications are indications. Small differences, for example because of screen settings or manufacturer changes, do not make a product defective.
  • Prices are stated in euros and include VAT, unless stated otherwise. Shipping costs and any other costs are shown before the customer confirms the order.
  • Prices may change at any time. The price shown at the time of the order applies.
  • Obvious mistakes or errors in prices or product information, such as a price that is clearly too low or a missing digit, do not bind Future Bike. In that case, Future Bike may cancel the order and will refund any payment already made.
  • Future Bike is not bound by offers or promotions that are not published on the Website or confirmed in writing.

4. Placing an Order and Formation of the Agreement

  • The customer places an order by completing the order process on the Website. Before the final confirmation, the customer can review and correct the order.
  • The agreement is formed when Future Bike confirms the order by email. An automatic message confirming that the order was received is not acceptance of the order.
  • Future Bike may refuse an order or cancel it, with a reason, for example in case of incorrect or incomplete information, a suspected fraud or misuse, failed or reversed payment, unavailability of the product, a pricing error, unusually large quantities or a delivery destination we do not serve. Future Bike will inform the customer and refund any payment already made.
  • The customer is responsible for providing correct and complete contact and delivery details. Future Bike is not liable for consequences of incorrect details.
  • Only persons aged 18 or older, or persons with the permission of their legal representative, may place an order.
  • Future Bike may limit the quantity of products per customer or per order.
  • Future Bike may carry out reasonable checks on payment and identity to prevent fraud.
  • The order confirmation contains the order details, the price, delivery information and information on the right of withdrawal. The customer should check it and keep it. Errors must be reported to Future Bike promptly.

5. Payment

  • The customer pays the full price, including shipping costs, at the time of the order, using one of the payment methods offered on the Website. Future Bike may refuse certain payment methods for certain orders.
  • Payments are processed by third-party payment providers. Their terms apply in addition to these Terms and Conditions. Future Bike is not responsible for the actions of payment providers.
  • Future Bike will only ship an order after payment has been received or confirmed by the payment provider.
  • If payment is not received, is cancelled or is reversed, Future Bike may suspend or cancel the order.
  • If a consumer does not pay on time after the agreed deadline, Future Bike will send a reminder and give the consumer 14 days to pay. If the consumer still does not pay, Future Bike may charge the statutory interest and statutory collection costs, to the extent permitted by law.
  • Business Customers who do not pay on time owe the statutory commercial interest and reasonable collection costs without a prior notice of default.
  • Before starting a chargeback or payment dispute with a bank or card provider, the customer must first contact Future Bike to resolve the issue. Unjustified chargebacks may lead to refusal of future orders.
  • The customer is responsible for any import duties, taxes or customs fees for deliveries outside the European Union, unless stated otherwise.

6. Delivery and Shipping

  • Future Bike delivers to the destinations shown in the order process. Delivery takes place at the address given by the customer when ordering.
  • Delivery times shown on the Website are indications and not strict deadlines. Exceeding a delivery time does not entitle the customer to compensation or cancellation, unless the law says otherwise.
  • Unless agreed otherwise, Future Bike delivers the order within 30 days of the day after the order. If the order cannot be delivered, or only partly delivered, the customer is informed within that period and may cancel the order and receive a refund.
  • If delivery is delayed, the customer can give Future Bike a reasonable written deadline to deliver. If delivery has not taken place after that deadline, the customer may dissolve the agreement in writing.
  • Future Bike may deliver an order in several parts. For consumers, this does not lead to extra shipping costs.
  • Bicycles and other bulky products may be delivered by a specialist carrier. The customer must make sure that someone can receive the delivery at the agreed address and that the product can be delivered without obstacles.
  • If delivery fails because the customer is not available or the address is incorrect, the carrier may leave a message. The customer is responsible for arranging a new delivery or collection. Costs of repeated delivery attempts or returns to our warehouse are borne by the customer, to the extent permitted by law.
  • The customer must inspect the packaging at delivery. Visible damage must be noted on the carrier’s delivery receipt and reported to Future Bike as described in Section 13.
  • The risk of loss or damage to the product passes to the consumer when the consumer or a third party designated by the consumer, other than the carrier, receives the product. For Business Customers, the risk passes when the product leaves our warehouse.

7. Retention of Title

  • Future Bike remains the owner of all delivered products until the customer has paid everything it owes for those products.
  • Until then, the customer may not sell, pledge or give the products as security to third parties, as far as the customer is a Business Customer.
  • If the customer does not pay, Future Bike may reclaim the products, to the extent permitted by law.

8. Assembly, Safety and Use

  • Bicycles and parts must be assembled, adjusted and maintained correctly. Bicycles may be delivered partly assembled. If you are not experienced in bicycle assembly, we strongly recommend that a professional bicycle mechanic does the final assembly and a safety check before the first ride.
  • Unless agreed otherwise in writing, assembly and adjustment by Future Bike is not included.
  • Before each ride, check the brakes, tires, wheels, quick releases, steering, saddle, pedals and all bolts. Do not ride a bicycle that is not safe.
  • Future Bike is not liable for damage or injury resulting from incorrect assembly, improper use, lack of maintenance, overloading, modifications or use not in line with the manual and the intended use of the product.
  • Follow the manufacturer’s manual, weight limits and maintenance schedule at all times. Not every bicycle is suitable for jumping, racing, off-road use or carrying children.
  • Always wear appropriate safety equipment, such as a helmet, and follow traffic rules and lighting requirements in your country.
  • The customer is responsible for making sure that the use of the product, in particular electric bicycles and speed pedelecs, complies with local laws and regulations, including requirements on age, licences, insurance, registration and speed limits.
  • Electric bicycles: use only the original or approved charger and battery, charge in a dry and ventilated place, never charge unattended or overnight, do not use a damaged, swollen or wet battery and do not open or modify the battery or motor. Follow the manufacturer’s storage and transport instructions.
  • Safety information, recalls and updates from manufacturers must be followed. The customer must keep the manual and contact details for such notices.

9. Product Specifications, Sizing and Compatibility

  • The customer is responsible for choosing the right size, type and specification. Size guides on the Website are indications only. Advice given by Future Bike is non-binding unless confirmed in writing.
  • Parts and accessories are not always compatible with every bicycle. The customer must check, before ordering, whether a part fits their bicycle, including frame, wheel size, brake type, axle standards, drivetrain, voltage and connectors. If in doubt, contact us before ordering.
  • Manufacturers may change specifications, colors or models without notice. Future Bike may deliver a product with equal or better specifications than the product ordered, if that does not disadvantage the customer.
  • Range, speed and battery performance of electric bicycles depend on factors such as rider weight, terrain, temperature, assist level and battery age. Figures shown are estimates and not guarantees.

10. Right of Withdrawal and Returns

  • Consumers may withdraw from the agreement within 14 days of receiving the product, without giving a reason, as described in the Return Policy.
  • The withdrawal period starts the day after the consumer, or a third party designated by the consumer other than the carrier, receives the product. For orders delivered in several parts, it starts the day after the last part is received.
  • The consumer must inform Future Bike of the withdrawal by a clear statement, for example by email to FutureBikeInfo@gmail.com, and may use the model withdrawal form in the Return Policy.
  • After the notice, the consumer must return the product within 14 days. Do not send anything back without written approval from Future Bike.
  • The costs of returning the product are borne by the consumer. We recommend a tracked and insured shipping method. Future Bike is not responsible for products that are lost or damaged in transit.
  • Returned products must be unused, unassembled and in the original, undamaged packaging with all accessories, manuals and tags. The consumer is liable for any loss in value caused by handling beyond what is needed to establish the nature, characteristics and functioning of the product.
  • A bicycle that has been assembled or ridden is considered used. Future Bike may deduct the loss in value from the refund.
  • The right of withdrawal does not apply to custom-made or personalized products, or to sealed products that are not suitable for return for health or hygiene reasons if the seal was broken after delivery.
  • Business Customers have no right of withdrawal or return, unless Future Bike agrees in writing.
  • The Return Policy contains the full conditions and procedure.

11. Refunds and Replacements

  • Refunds are made to the payment method used for the original purchase, unless agreed otherwise.
  • Future Bike issues a refund only after it has received the returned product in good order and has inspected it. If the inspection shows that the product meets the conditions of the Return Policy, the refund is processed and the customer is informed by email.
  • For consumers who withdraw, Future Bike refunds the payments received, including the costs of standard delivery, within 14 days of receiving the notice of withdrawal. Future Bike may withhold the refund until it has received the product back or the customer has provided proof of shipment, whichever is earlier. Additional costs for a delivery method more expensive than our standard delivery are not refunded.
  • If the product is damaged, incomplete or used beyond what is allowed, Future Bike may reduce the refund by the loss in value or refuse the return.
  • Instead of a refund, the customer may request a replacement product in the email requesting the return. A replacement is subject to availability and to the same conditions and costs as a return. Future Bike sends the replacement after receiving and inspecting the original product. If the product is no longer available, Future Bike offers a refund instead.

12. Conformity and Warranty

  • Future Bike delivers products that conform to the agreement, meet reasonable requirements of reliability and usability and comply with the legal provisions that apply on the day of the agreement. The statutory rights of consumers concerning non-conforming products remain unaffected.
  • Manufacturer warranties, where applicable, apply in addition and under the manufacturer’s conditions. Any additional guarantee that Future Bike gives is stated in writing.
  • Warranty and conformity claims do not cover damage or defects caused by:
    • incorrect assembly, adjustment or installation;
    • accidents, falls, collisions, overloading or misuse;
    • lack of maintenance, incorrect storage, cleaning or charging;
    • use not in line with the manual or the intended use of the product;
    • repairs, changes or modifications by the customer or third parties not authorized by Future Bike;
    • the use of non-original or incompatible parts;
    • normal wear and tear.
  • Wear parts, such as tires, inner tubes, brake pads, chains, cassettes, cables, grips, saddle covers and bulbs, wear out through normal use. Normal wear of these parts is not a defect.
  • Batteries lose capacity over time. A gradual loss of capacity through normal use and age is not a defect.
  • The customer must be able to show the purchase, for example by order number or invoice.
  • If the defect is established, Future Bike will, at its choice, repair or replace the product free of charge. If repair or replacement is not possible, or not possible within a reasonable time, the customer may dissolve the agreement or ask for a price reduction, as provided by law.
  • Future Bike decides on the way repair or replacement is carried out. The customer may be asked to send the product back for inspection, in the original packaging where possible. Costs of this are borne by Future Bike if the defect is established.
  • Future Bike is not obliged to repair or replace a product if the customer has used it in a way that makes inspection impossible, or if assessing the defect would be unsafe.

13. Claims Procedure for Defects and Damage in Transit

  • Damage in transit: check the packaging and product on delivery. Report visible damage on the carrier’s receipt where possible, and email Future Bike at FutureBikeInfo@gmail.com within 48 hours of delivery, with your order number and clear photos of the packaging, the product and the damage.
  • Other defects: report the defect to Future Bike as soon as possible after discovering it. For consumers, a report within two months of discovery is considered to be in time. Reports that are made later may be refused, to the extent permitted by law.
  • Every claim must include the order number, a description of the problem and photos or video that show the defect. Future Bike may ask for further information or for the product to be returned for inspection.
  • Do not use the product further if it is unsafe. Keep the original packaging until the claim has been settled.
  • Future Bike will confirm receipt of the claim and aims to respond within 14 days. Future Bike will tell the customer whether the claim is accepted and how it will be solved.
  • Claims that are made without proof, or for damage caused by the reasons mentioned in Section 12, may be rejected.
  • Do not send back a product without written approval from Future Bike.
  • Submitting a claim does not suspend the customer’s payment obligations.

14. Cancellation and Changes of Orders

  • After the agreement has been formed, the customer cannot cancel or change an order, unless Future Bike agrees in writing or the law gives the customer this right. A request to cancel or change an order should be sent to FutureBikeInfo@gmail.com as soon as possible. Future Bike will try to accommodate it if the order has not yet been processed or shipped.
  • This does not affect the right of withdrawal of consumers, as described in Section 10.
  • If Future Bike agrees to a cancellation after the product has been prepared or shipped, Future Bike may charge reasonable costs, such as shipping and handling costs, to the extent permitted by law.
  • Future Bike may change or cancel an order if a product is no longer available, if the manufacturer discontinues a product or if circumstances beyond our control make delivery impossible. In that case, Future Bike informs the customer promptly and refunds any payment.

15. Pre-orders, Backorders and Availability

  • Products shown as pre-order or backorder are not in stock. Delivery dates are estimates and can change because of manufacturer or supplier delays.
  • Future Bike will inform the customer of significant delays. If the product is not delivered within 30 days of the order, the rules on late delivery in Section 6 apply.
  • Stock levels shown on the Website are indications and may not be fully up to date. Future Bike is not liable if a product turns out to be unavailable after the order has been placed.

16. Promotions, Discounts and Vouchers

  • Promotions, discounts and vouchers are only valid for the period and under the conditions stated on the Website or in the offer.
  • Unless stated otherwise, discounts cannot be combined and have no cash value.
  • Future Bike may withdraw or change promotions at any time before an order is confirmed. Misuse of promotions, including multiple use of one-time codes, can lead to cancellation of the order.
  • If an order is returned, the discount applied to that order is deducted from the refund in proportion to the returned product.

17. Customer Account and Use of the Website

  • If the customer creates an account, the customer must provide correct information and keep it up to date.
  • The customer must keep login details confidential and is responsible for all activity under the account. The customer must inform Future Bike immediately of unauthorized use.
  • Future Bike may block or remove accounts in case of misuse, fraud or breach of these Terms and Conditions.
  • The customer may not use the Website in an unlawful way, disrupt its operation, attempt to gain unauthorized access, collect data automatically (scraping), or place orders with a false identity.
  • Future Bike does its best to keep the Website available and accurate, but does not guarantee that it is free from interruption, errors or viruses. Links to third-party websites are provided for convenience. Future Bike is not responsible for their content.

18. Business Customers

  • This Section applies in addition to the other Sections if the customer is a Business Customer.
  • The right of withdrawal and the statutory consumer protection provisions do not apply to Business Customers, to the extent permitted by law.
  • The Business Customer must inspect the products immediately on delivery and report visible defects in writing within 48 hours of delivery. Other defects must be reported in writing within 8 days of discovery, and in any case within 12 months of delivery. After that period, no claims can be made.
  • Future Bike’s liability towards Business Customers is limited to repair or replacement of the product, or to the invoice value of the product concerned, whichever Future Bike chooses.
  • The Business Customer indemnifies Future Bike against claims by third parties concerning products supplied, to the extent the Business Customer caused the damage by incorrect use, assembly, modification or resale.
  • Claims of the Business Customer against Future Bike lapse 12 months after delivery.

19. Liability

  • Future Bike is only liable for damage that is the direct result of an attributable failure on its part, and only to the extent permitted by law.
  • Unless the damage is caused by intent or gross negligence of Future Bike, Future Bike’s total liability for each event or series of related events is limited to the purchase price of the product concerned.
  • Future Bike is not liable for indirect damage, such as loss of profit, loss of use, lost savings, business interruption, loss of data or consequential damage.
  • Future Bike is not liable for damage caused by incorrect assembly, improper use, lack of maintenance, use contrary to the manual or the law, or products that were modified.
  • Future Bike is not liable for the acts or omissions of carriers, payment providers, manufacturers and other third parties, unless the law says otherwise.
  • Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by Future Bike, for intent or gross negligence, or for any liability that cannot be limited or excluded by law. The statutory rights of consumers are not affected.
  • Claims for damages lapse if the customer has not reported them to Future Bike in writing within a reasonable time after discovering the damage, to the extent permitted by law.

20. Force Majeure

  • Future Bike is not in breach of the agreement if it cannot meet its obligations because of circumstances beyond its reasonable control (force majeure). These include strikes, transport and carrier disruption, delays or shortages from suppliers or manufacturers, customs problems, fire, flooding and other natural disasters, war, terrorism, epidemics, power or internet outages, cyber-attacks and government measures.
  • During force majeure, Future Bike may suspend its obligations. If the situation lasts longer than 60 days, either party may dissolve the agreement in writing, without liability for damages.
  • If Future Bike has already partly performed, it may invoice the part that has been delivered. If delivery is impossible, Future Bike will refund any payment for the part that was not delivered.

21. Complaints

  • Please send complaints about our products or service to FutureBikeInfo@gmail.com as soon as possible after discovering the problem, with a clear description, your order number and, where relevant, photos.
  • Future Bike confirms receipt of the complaint and aims to respond within 14 days. If a complaint needs more time, Future Bike will tell the customer when to expect a full answer.
  • A complaint does not suspend the customer’s obligations under the agreement, unless Future Bike agrees in writing.
  • Future Bike keeps records of complaints and uses them to improve its service.

22. Dispute Resolution

  • If a complaint cannot be solved together, a consumer may submit the dispute to the competent body or court. Consumers in the European Union may also use the European Commission’s Online Dispute Resolution platform where this is available.
  • Before starting legal proceedings, the parties will first try in good faith to solve the dispute through direct contact.

23. Privacy and Data Protection

  • Future Bike processes personal data only as needed to handle orders, deliver products, handle payments, provide service, prevent fraud, keep records and meet legal obligations, in line with applicable data protection law, including the General Data Protection Regulation (GDPR).
  • The personal data we process can include name, address, email address, phone number, order and payment details and communication with us.
  • Data is shared only with parties needed to fulfil the order or meet legal duties, such as payment providers, carriers, IT providers and authorities. We do not sell personal data to third parties.
  • Data is kept no longer than necessary for these purposes and as required by law, for example for tax records.
  • The customer has the right to access, correct, delete and restrict the use of personal data, the right to object, the right to data portability, and the right to lodge a complaint with the data protection authority. Requests can be sent to FutureBikeInfo@gmail.com.
  • Future Bike only sends marketing messages if the customer has given consent or the law allows it. The customer can unsubscribe at any time.

24. Cookies

The Website may use cookies and similar technologies that are needed for it to work, such as to remember the shopping cart, and, with the customer’s consent where required, for analytics and marketing. The customer can manage cookie settings in the browser and, where offered, on the Website.

25. Intellectual Property

  • All content on the Website, including text, images, photos, logos, product descriptions, designs and software, belongs to Future Bike or its suppliers and is protected by intellectual property laws.
  • The customer may not copy, distribute, change, republish or use this content for commercial purposes without prior written permission from Future Bike.
  • Brand names and logos of manufacturers belong to their owners. Their use on the Website does not imply any link or endorsement.

26. Communication

  • Communication between Future Bike and the customer takes place by email, unless agreed otherwise. The customer must keep the email address given to Future Bike up to date and check it regularly, including the spam folder.
  • Notices sent to the email address provided by the customer are considered received on the day they are sent.
  • Future Bike is not responsible for messages that are not received because of incorrect contact details or technical problems on the customer’s side.

27. Assignment and Subcontracting

  • Future Bike may transfer its rights and obligations under the agreement to a third party, for example in a sale of the business. The customer will be informed of this where required.
  • Future Bike may use third parties, such as carriers and suppliers, to perform the agreement.
  • The customer may not transfer its rights or obligations under the agreement without written permission from Future Bike.

28. Severability

If a provision of these Terms and Conditions is found invalid or unenforceable, the other provisions remain in force. The invalid provision is replaced by a valid provision that comes as close as possible to the original purpose.

29. No Waiver

If Future Bike does not use a right or does not enforce a provision at any time, this does not mean that Future Bike gives up that right or provision. A waiver is only valid if made in writing.

30. Entire Agreement

These Terms and Conditions, the Return Policy, the order confirmation and any written agreements confirmed by Future Bike form the entire agreement between Future Bike and the customer. They replace all earlier agreements, promises and statements on the same subject.

31. Changes to These Terms

  • Future Bike may change these Terms and Conditions at any time. The new version applies from the date it is published on the Website.
  • The version in force at the time of the order applies to that order.
  • Changes do not reduce statutory consumer rights.

32. Language

These Terms and Conditions are drawn up in English. If they are translated into another language, the English version prevails in case of differences, to the extent permitted by law.

33. Applicable Law and Jurisdiction

  • Dutch law applies to all offers, agreements and disputes between Future Bike and the customer. The Vienna Sales Convention (CISG) does not apply.
  • Mandatory consumer protection rules of the country where the consumer lives remain unaffected.
  • Disputes will be brought before the competent court in the Netherlands, unless the law gives a consumer the right to go to the court where they live or mandatory law says otherwise.

34. Contact
